GENERAL TERMS AND CONDITIONS
LUX ADRIA is a travel agency (hereinafter: the Agency) owned by the individual Matej Rotim. The Agency specialises in mediation in the rental of private villas, holiday homes with swimming pools and apartments, with the aim of providing the highest possible service quality to its guests. All displayed villas are under contract with LUX ADRIA and hold all permits issued by the competent state authorities.

INTRODUCTION
Lux Adria acts as an intermediary between the tenant (Guest) and the owner of the villa/holiday home (Owner/Lessor). By paying the advance payment for the reservation of the selected accommodation for the requested period, the Guest accepts these General Terms and Conditions. Any amendments or annexes to the rental agreement are valid only if made in writing and expressly accepted by both parties.
By paying the advance payment for reserving a selected villa, holiday home or apartment for the desired dates, you unconditionally agree to these General Terms and Conditions published on the Lux Adria website: www.luxadria.com, effective from the date of publication.
After Lux Adria receives the advance payment, the Guest will be sent a document titled “Booking Confirmation” stating the amount paid. The written Booking Confirmation together with these Terms and Conditions constitutes the rental agreement between the Guest (tenant) and the Owner (lessor).
The Guest must be at least 18 years old on the booking date.
ARRIVAL AND DEPARTURE
Earliest check-in is 4:00 pm on the day of arrival. Check-out is no later than 10:00 am on the day of departure. Early check-in or late check-out is possible only if the Owner approves it upon the Guest’s request.
Guest registration
Under Croatian law, the Guest must provide the Owner/host with official identification documents for tourist registration with the Croatian Tourist Board (HTZ). These details will not be used for any other purpose. If the Guest fails to present legally required identification, access to the accommodation may be denied without any right to a refund.
Number of guests
At no time may there be more persons in the property than stated in the Booking Confirmation. The number of guests may be increased up to the maximum capacity shown on the property page, provided the request is submitted in writing by e-mail at least 3 (three) days prior to arrival. The maximum number applies to children as well, regardless of age.
If more persons than announced are present in the villa/holiday home/apartment or on its premises, the Owner and/or Lux Adria reserve the right to terminate the rental agreement immediately, without prior notice. The Guests must vacate the property permanently within 2 (two) hours. No refund for the unused rental period will be granted.
Younger guest groups
Groups where members are 22 years old or younger are considered a younger guest group. Special conditions may apply depending on the policy of each property. Lux Adria must be informed of the group’s age in advance or immediately after booking. Failure to comply may result in immediate cancellation without refund.
Tents and caravans
Parking or placing tents, caravans and similar equipment in or near the villa is not allowed. In case of violation, the Owner and/or Lux Adria may terminate the agreement immediately. The Guest must vacate within 2 hours and is not entitled to a refund.
Pets and allergies
Whether pets are allowed, and under which conditions/costs, is stated on each property page. Pets are strictly forbidden from entering swimming pools. Any additional cleaning costs are stated on the property page and (where applicable) are automatically added during booking. The number of pets may not exceed the number stated in the Booking Confirmation. For more than 2 (two) pets, the Guest must contact the Agency; more than 2 pets require written consent.
Pet owners are responsible for cleaning pet waste. Pets must not be on furniture at any time; evidence may lead to additional cleaning fees. All pets must be vaccinated against rabies and other diseases in accordance with applicable regulations. The Guest bears sole responsibility for the pet; the Owner and the Agency accept no liability for illness or injury to the pet during the stay.
Even in “no pets” properties, neither the Owner nor the Agency can guarantee that pets have never been present previously or that the Owner does not keep pets. The Agency is not responsible for any allergic reactions.
If a Guest brings an unannounced pet, the Owner and/or the Agency may terminate the agreement immediately. The Guest must vacate within 2 hours; no refund applies.
Newly built villas
When booking newly built properties, the Guest acknowledges that the landscaping (lawn, plants, flowers, etc.) may not yet be fully established. Guests will be informed in due time and can decide accordingly.
Noise
If Guests disturb public order and do not calm down after a warning, this may be treated as a serious breach of the rental agreement. The Owner and/or the Agency may terminate the agreement with immediate effect. The Guest must vacate within 2 hours; no refund applies.
Pools / hot tubs
For safety reasons, the Guest shall follow all instructions of the Owner or the Agency. The Guest is fully responsible for pool use. Children may access the pool only under adult supervision. Use is at the Guest’s own risk. Outside the summer season, the pool may not be available.
Use of hot tubs and pools may be hazardous to health and is at the Guest’s own risk. Hot tub water may not reach full temperature until the evening on the arrival day. Standing on hot tub covers is prohibited; covers are for insulation only and can be damaged. In case of damage, the Guest compensates the Owner directly.
House rules
Each property has specific house rules displayed in a visible place. Guests must comply. Non-compliance may be treated as a serious breach and may result in immediate termination. The Guest must vacate within 2 hours; no refund applies.
PRICES AND PAYMENTS
Unless stated otherwise, all prices are in EUR per villa, calculated on a daily or weekly basis. The booking is binding. During the booking process, an advance payment of 30% of the agreed rental price is required, by which the booking is confirmed, the contract with the Owner is concluded and these Terms are accepted as an integral part of the rental agreement.
After the booking process and full payment are completed, the Agency will send a written Booking Confirmation by email containing all necessary accommodation details. Together with these Terms, it constitutes the rental agreement. Water, gas and electricity consumption, internet, bed linen, kitchen towels, final interior cleaning, pool and exterior maintenance, registration and tourist tax, and VAT are included in the rental price.
For the deposit (30%) and the remaining payment (70%), only bank transfers to the Agency’s account specified in these Terms are accepted. All payments are made in EUR.
Cancellations must be sent in writing to [email protected] or [email protected], including the reason. Depending on the cancellation date, penalties apply:

up to and including 60 days before arrival: 0%

up to and including 30 days before arrival: 70%
-
up to and including 29 days before arrival: 100%
Bookings made 30 days or earlier before arrival require payment of the total booking amount at the time of booking.
Failure to meet payment deadlines
The Guest undertakes to pay within the deadlines defined herein. Failure to comply is considered a serious breach; the rental agreement is deemed terminated without notice. Amounts paid to the Agency will not be refunded.
TERMINATION AND CHANGES
The rental agreement may be terminated only in writing (by e-mail). Termination takes effect from the day the written notice is received, and only under the conditions stated herein.
If the Guest finds a substitute Guest for the same dates, at the same price and under the same conditions, the Agency will transfer the rental agreement to the substitute after receiving all necessary details in writing and will send written confirmation. Amounts already paid are retained by the Agency; the substitute Guest must pay the remaining balance according to the selected payment method.
A booking cannot be transferred to another villa because the Agency forwards all payments to the respective Owners without delay.
If performance becomes impossible or significantly more difficult due to force majeure (e.g., war, natural disasters, ecological disasters, epidemic, border closure, strikes, etc.) that could not be foreseen at the time of contracting, the Agency and the Owner may terminate the agreement; neither shall be liable for such circumstances.
SECURITY DEPOSIT (DAMAGE DEPOSIT)
The amount of the security deposit payable to the Owner/host upon arrival is stated in the Booking Confirmation. It serves as security for damage. If damage exceeds the deposit, the Guest compensates the full amount. If no damage occurs, the Owner returns the deposit upon departure.
DAMAGES / GUEST RESPONSIBILITY
The Guest undertakes to use the property responsibly and return it in the condition in which it was received. The Guest is directly liable to the Owner for any damage. If the deposit is insufficient, the Guest pays the difference up to the full amount.
Intentional damage or disturbance of public order is a serious breach and may result in immediate termination without refund. The Guest must vacate within 2 hours.
The Guest must immediately inform the Owner of any damage. Before departure and key handover, the Guest and Owner/host shall inspect the property and premises together. Additional cleaning due to unusually poor condition may be treated as damage and paid from the deposit.
EXISTING DEFECTS AND COMPLAINTS
If the Guest notices inadequate cleaning, damage or deficiencies upon taking over the property, they must be reported immediately and in any case within 24 hours. Cleaning complaints must be reported immediately. Complaints are submitted directly to the Owner/representative and/or the Agency. The Guest must allow a reasonable time for remedy.
Leaving the property before the end of the rental period without prior notice and consultation with the Agency is at the Guest’s risk and cost; the Agency assumes no liability. The Owner is responsible for deviations from the description.
LUX ADRIA AS AN INTERMEDIARY
Lux Adria acts solely as an intermediary based on mediation agreements with Owners and is not the Owner of the properties. The Owner is obliged to provide accurate and complete information and bears full responsibility towards the Guest. If, contrary to expectations, a booking cannot be realised due to circumstances beyond Lux Adria’s control (e.g., court sale or serious breach by the Owner), Lux Adria may cancel and immediately refund payments made by the Guest.
FINAL PROVISIONS AND JURISDICTION
The Agency publishes property information on www.luxadria.com and strives for accuracy; Owners bear exclusive responsibility for correctness and completeness. Any commercial use or reproduction of website content constitutes copyright infringement and is prohibited.
In case of breach, the Owner (in agreement with the Agency) and/or the Agency may terminate the rental agreement immediately. The Guest must vacate within 2 hours and has no right to a refund. Parties will attempt amicable settlement; the competent court is the locally competent court in Pula.
